1.1 If the Merchant request website design service from the Provider; Provider shall design, construct, maintain and host a webpage under the name and storage capacity stated in the Merchant Application Form and such webpage shall provide a link to the Internet Payment Gateway of a Licensed Commercial Bank where the Provider has been registered. The Merchant’s webpage shall be hosted in the Provider’s web server. The Provider shall provide a Merchant Identity (Merchant ID) for every Merchant and further storage capacity at the Merchant’s request for an additional payment.
1.2 If the Merchant request website design service from the Provider; Provider shall provide a secure link (the Secure Link) between the Merchant’s web browser and Provider’s web server and between the Merchant’s web browser and the Provider’s website and the Bank’s web server based on 128-bit or higher Secure Socket Layer Encryption to facilitate data confidentiality and data integrity. In a situation where the Merchant maintains his/her own independent website or domain name the Merchant shall be responsible for the security thereof.
1.3 The Provider shall ensure the Licensed Commercial Bank with it shall respond to internet transactions done with MasterCard©, VISA, AMEX, EZCash, MCash, Sampath Vishwa, DFCC Vardhana Wallet and such other payment methods as the case may be including debit cards authorized for online transactions by the issuing Bank.
1.4 The Provider shall maintain a Reserve Account to which the Bank shall remit funds collected from transactions carried out through the Secure Link of the Internet Payment Gateway provided by the Provider to the Merchants less the applicable transaction commission as set out in the Merchant Application Form.
1.5 The Provider shall settle all Merchant payments after the settlement /or goods delivered/service rendered date (which are in ‘Complete’ status in the system) in respect of all transactions carried out using the Internet Payment Gateway by considering defer days. Provider has the right to hold the payment until required documents are submitted by the Merchant. THIS WITHHOLDING OF SUCH PAYMENT DOES NOT BREACH THE Provider’s right to deduct any sums due from the merchant FOR ANY OTHER BREACH BY THE
1.6 The Provider will commence billing the Merchant 30 days from date of signing the agreement.
1.7 The Provider shall not be liable for any transactions done by the Merchant on a ‘Cash on Delivery ‘basis.
